Worcester v. Georgia

​The Cherokee Fight Back

The Cherokee fought for their rights to land in Georgia through the Supreme Court.

The Supreme Court refused to recognize them as a nation or state and would not hear their case.

The Cherokee came back with Samuel Worcester, a minister who had been jailed for teaching Natives without a license.

The Supreme Court rules in FAVOR of the Cherokee Nation

The US is NOT allowed to regulate or invade land set aside for the Cherokee

Why is this forced removal referred to as the Trail of Tears?

• Native's land was forcefully stolen

• About 1/4 of Native's perished on the journey

• It was 800 miles mostly on foot

• Government officials and outlaws stole from them along the way

• Their new land was far inferior to the land they had been forced to leave
